In these terms and conditions the following expressions shall bear the following meanings: "the company" shall mean nitrohosting.net and "the customer" shall mean the person, firm or company placing the order for services.

Acceptable Use

The services provided by the company may not, under any circumstances be used for the storage, transmission or presentation of any of the following:

Bulk unsolicited mail (spam)

Pornography

Warez / Cracks

Hate, defamatory or discriminatory material

Copyrighted material where permission to distribute has not been granted

Any material that is libellous, abusive or harassing, that constitutes unauthorised advertising, encourages conduct that would constitute a criminal offence or may give rise to civil liability.

Any other material which may be in violation of UK law.

The customer accepts responsibility and liability for all data stored, transmitted or presented on or via their account through the company's servers and understands that the company will not be held liable for any legal action which may result from a customer's actions. The company does not actively monitor site content however if any files are reported or found to be in violation of these terms of service the severity of the action taken is at the sole discretion of the company.

The customer agrees not to use scripting capabilities in a malicious manner and that any script uploaded to the the company's servers will have been thoroughly tested. Any processes that are found to be behaving in an unusually detrimental way to the performance of the company's servers may be disabled pending customer cooperation.

The customer also agrees not to use the services provided on the company's network to attempt to circumvent any system security or copy protection mechanisms including, but not limited to, password cracking, denial of service attacks or port scanning any system without prior express written permission. Such activities may result in criminal proceedings.

Security & Backups

The customer agrees that the company may perform non-destructive security audits at any time, on any site or server on the company's network in order to ensure the network and servers and the data on them remain secure. We will take any action necessary to protect the integrity of our network but sole responsibility for individual account security lies with the customer.

Backups will be regularly taken of all data on the servers for the purpose of restoration after multiple disk failure, however it is the responsibility of the customer to ensure that all their data, including that in any database, is backed up.

Termination

The company reserves the right to terminate the customer's account with immediate effect and issue a pro rata refund for the current month. Any account terminated because of a violation of the terms of service will not be eligible for a refund.

The company also reserve the right, at its sole discretion, to refuse service.

A customer may cancel their account at any time by giving one months notice by email.

Billing

The customer agrees that bandwidth used over and above the allocated amounts for any account will be charged to that account the following month.

Refunds for any service will be given at the sole discretion of the the company management.

Prices shown in any price list are subject to alteration by the company without prior notice.

Late Payment

The customer will be notified by email each time a payment is due or will shortly be due. Any account paid yearly will become due on the same date the following year.

Service will be suspended on any account which remain unpaid 10 days after due. An administration fee of £5 will be made due if an account remains unpaid 14 days after due.

Disclosure

The customer understands that the company will not disclose any personal information unless required to do so by law.

Availability

The customer acknowledges that the service provided may be interrupted by reasons other than the negligence of the company. Therefore the customer agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. The customer further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by the customer for services during the period in which damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

Disclaimer

The company makes no warranties of any kind, expressed or implied for services provided and disclaims any warranty, merchantability or fitness for a particular purpose. The company do not provide an uptime guarantee, but will always endeavour to resolve any problem as soon as humanly possible. Scheduled maintenance will always be announced.

The customer agrees to accept liability for any demands, losses, claims and costs incurred from any action asserted against the company as a result of services provided or pending
